New rule: victims of modern slavery can leave an abusive sponsor and keep their visa

Something changed today that a lot of people have waited years for. From 3 September 2026, a Skilled Worker visa holder who is officially recognised as a victim of modern slavery can work for any employer for the rest of their visa. They do not have to find a new sponsor first, and leaving does not end their right to be here.

Until today, your visa was tied to the company that sponsored you. If that company treated you badly, leaving could cost you your status. Plenty of people stayed in jobs that frightened them for exactly that reason.

What the rule actually says

• It applies to Skilled Worker visa holders, including care workers, chefs and hospitality staff.
• You must be recognised by the Home Office as a victim of modern slavery.
• Once recognised, you may work for any employer for the time left on your visa.
• You do not need a new certificate of sponsorship to move.

The part the rumours leave out

This protection is not automatic. You must first be recognised through the National Referral Mechanism (NRM) and receive a positive conclusive grounds decision. Until that decision comes, the old rules still apply to you.

That matters more than anything else on this page. If you walk out of your job today expecting this rule to protect you, and you have not been through that process, you are not covered yet. Get advice first.

What modern slavery means here

It is wider than most people think. Wages held back or taken. Threats. Your passport kept from you. Being told you will be deported if you complain. Hours or conditions you never agreed to. Being made to pay back money you never borrowed.

If you recognise your own life in that list, you are not making a fuss. That is what the rule was written for.
